***Terms & Conditions***
By bidding on and/or buying any item offered by the auction company you hereby agree to be bound by the following Terms and Conditions and acknowledge you are entering into a legal and binding contract. IF YOU DO NOT AGREE WITH THE TERMS AND CONDITIONS, DO NOT BID ON ITEMS OFFERED BY THE AUCTION COMPANY. READING AND UNDERSTANDING THESE TERMS IS YOUR RESPONSIBILITY, NO EXCEPTIONS!
The auction company may, at their discretion, update the Terms and Conditions at any time.
As used in the Terms and Conditions, "you" are an individual acting on your own behalf, or an agent of a person or entity that has authorized you to act on their behalf; "we" and "us" and "our" means the auction company. We reserve the right to rescind or reject and all bids. Retractions will be assessed individually upon request.
***ITEM INSPECTIONS AND GUARANTEES***
Our inspections are merely visual and limited to what our sales agent sees and hears the day of listing and dependent on statements made by sellers to us. Therefore, all items are sold "AS IS" and "WHERE IS" with no guarantees or warranties expressed or implied. Information, descriptions, and details, including but not limited to, year, make, model, mileage, hours, and condition, are deemed correct but are NOT GUARANTEED and you are responsible for your own due diligence. We DO NOT guarantee that any emission systems are intact or guarantee the functionality of any emission systems. Personal or independent 3rd party inspections are recommended and encouraged before bidding to verify the accuracy of any and all descriptions and information, written or oral, provided by us or our agents. All sales are FINAL.
***TRANSPORTATION, LOADING AND UNLOADING***
Your purchased items must be removed from their location as stated within the auction documents. A relocation fee may apply for items being sold that are not located at our facility. You are solely responsible to arrange transportation. The auction company DOES NOT transport or ship items but may refer you to competitive shippers if needed. We do not provide loading and equipment tear down, if you require assistance, you must arrange it with your shipping provider or hire someone at your expense to provide this service. We may however be able to refer you to someone that provides this service in the area in which your purchased item is located. Please call prior to bidding or purchasing.
***TITLES AND TITLED VEHICLES***
Titles will be completed using the name and address of the registered buyer and sent via Certified Mail to the registered address within 30 days of payment clearing.
An invoice will be emailed to you after the auction close. All purchases with a sales total of less than $2000 will be automatically charged to your credit card used to register to bid immediately following the close of the auction. If you failed to enter your tax exemption information at registration, please notify the office prior to bidding. Purchases over $2000 are to be paid in full within 24hours of the auction close with another form such as wire transfer ($20 fee applied), personal check or cash. Payments not received within 24 hours of the auction close will be assessed a late fee of $50. Additional fees may apply to your winning bid such as internet premium, sales tax, incoming bank wire fee ($20 fee), etc. Acceptable forms of payment are bank wire transfer ($20 fee) or credit card (4% fee). NO International payments will be accepted. All forms of payment must clear our financial institution prior to items being released. Items will not be released without paid receipt in hand at the time of pickup. Please do not call the office about arranging pickup until after the auction is complete and your invoice is paid in full.
Any applicable sales tax laws apply per the location of the seller of the item and are in addition to the final bid amount. Tax exemption forms will be provided by us and are required to be completed by you to claim exemption for farm use or resale IF any sales tax is applicable. All exemption forms and/or necessary documents must be provided prior to bidding.
Payment terms above apply to all purchases unless prior financing or payment arrangements have been made with us in advance.
Failure to pay for auction purchases will result in permanent denial of your bidding privileges with us in the future, collection proceedings, and use of any credit reporting tools available to the auction company. Buyer in default of payment will be responsible for any fees associated with recovery of such debt owed to us.
Items not picked up by dates outlined in the associated auction will be considered abandoned by the buyer, become property of the seller and/or the auction company to sell or retain without further notice to the buyer.
